A employee compensation policy cover the legal liability of an employer to provide compensation to its workmen in case of their death or accident. Also know as employee compensation or labor insurance.

It applies to workmen employed in factories, mines, plantations, transport establishments, construction work, railways, ships, circuses, & other hazardous occupations & employments specified in Schedule II to the Act.Every employee, including those employed through contractor are also covered. The coverage of this act is also to cooks employed in hotels and restaurants. The Act extends to the whole of India.

The Act does not apply to members of Armed Forces of the Union & workmen who are covered by the ESI Act, 1948.

The compensation to be paid by the employer depends upon the age of the employee, nature of injury and the average monthly salary or wages paid to them. However the minimum & maximum rate is fixed for death & disability, subject to timely revision.

To pay the compensation the insured employer is legally liable to pay to his employees and their dependents due to the death or injury caused by accidents or diseases contracted due to the work and during the course of the employment.

To fulfill the insured employer’s liability arising either under:

  • The Employees Compensation Act, 1923
  • The Fatal Accidents Act, 1855
  • Common Law
  • Bodily injury caused by accident during the course & scope of the employment.
  • Bodily injury caused by disease or aggravated by the conditions of the employment.

Death:
50* monthly wages* Relevant factor of age or 120000 whichever is higher.

Permanent Total Disability:
60* monthly wages* Relevant factor of age or 140000 whichever is higher.

Permanent Partial Disability:
40% of 60* Relevant factor of age.

Temporary Disablement:
The amount of compensation shall be a half monthly payment of the sum equivalent to 25% of the monthly wages of the workman.
